Terms of engagement

Introduction
Welcome to the Strong and Nourished Programme. This programme is delivered by Holly Davison of East Fit PT and Josie Jones of The Mindful Cook.

By enrolling in the programme you agree to these Terms of Engagement. These terms outline the responsibilities of both the providers and the participant and explain how the programme will be delivered.

Programme overview
The Strong and Nourished Programme is a structured online coaching programme designed to support participants in developing sustainable nutrition and strength training habits.

Programme duration
The programme runs for six weeks, with an additional preparation week before the official start date.

Services included

Participants will receive:

Access to three two week meal plans with supporting shopping lists
Access to approximately 100 recipes to support meal planning
Approx eighteen resistance training workouts designed to build strength and fitness
Access to an online community for support and discussion
Regular check ins and support from Holly Davison and Josie Jones
Live coaching sessions throughout the programme

Details of sessions and programme materials will be communicated through the programme platform.

Participant responsibilities

Participation
Workout programmes and nutrition guidance are provided as part of the programme. Participants may complete workouts at times that suit their personal schedule.

Participants are encouraged to follow the training and nutrition guidance provided as closely as possible in order to support their progress. However, it is the participant’s responsibility to implement the guidance appropriately and communicate openly during check ins if support or adjustments are required.

Health disclosure
All participants must complete the new starter questionnaire before the programme begins. This questionnaire includes information relating to health status, injuries, exercise readiness and dietary requirements.

Participants must provide accurate and complete information. If a participant’s health circumstances mean the programme is unsuitable for them, they may be advised not to participate and will be entitled to a full refund.

Medical responsibility
Participants are responsible for seeking advice from a qualified healthcare professional before beginning the programme if they have any concerns about their health or ability to participate safely.

If a participant answers yes to any questions within the PARQ exercise readiness questionnaire, it is their responsibility to seek appropriate medical clearance before participating in the exercise programme.

Participants agree to take responsibility for managing their own health, injuries and wellbeing during the programme.

Payment and cancellation

Programme fee
The total cost of the Strong and Nourished Programme is £297. Payment must be made in full before the programme begins unless a split payment option has been selected.

Where the split payment option is used, the second payment will automatically be taken 30 days after the first payment.

Cooling off period
Under UK consumer law you have the right to cancel your purchase within 14 days of purchase without giving a reason.

If you cancel within this 14-day period and the programme has not yet started and you have not accessed programme materials or the online community, you will receive a full refund.

Start of service
By enrolling in the programme you acknowledge that access to programme materials, the online community or coaching support may be provided before the end of the 14-day cooling off period.

By accessing programme materials, joining the community or attending any sessions you acknowledge that the service has begun.

Loss of cancellation right
Once the programme has commenced or programme materials or community access have been used, refunds will not be available.

Exception
If, after completing the new starter questionnaire, a participant is deemed unsuitable for the programme due to health reasons, a full refund will be provided.

Programme delivery

Workouts
Workout plans will be delivered through the designated programme platform. Participants may complete workouts at times that suit their individual schedule.

Attendance at live sessions is optional unless otherwise stated.

Meal plans and recipes
Meal plans, recipes and supporting materials will be delivered digitally through the programme platform or via email.

Coaching sessions
Live coaching sessions will be delivered online. Details and access information will be shared within the programme platform.

Nutrition guidance disclaimer

Nutrition information provided within the Strong and Nourished Programme, including meal plans, recipes, calorie guidance and educational materials, is intended for general educational purposes only.

The nutrition guidance provided is not a substitute for personalised medical or dietetic advice. Participants should consult a qualified healthcare professional, GP or registered dietitian before making significant dietary changes, particularly if they have a medical condition, food allergy, history of disordered eating, or are pregnant or breastfeeding.

While every effort is made to ensure the accuracy of nutrition information, the providers cannot guarantee specific health outcomes.

Calorie and nutrition targets

Where calorie ranges, protein targets or other nutritional guidance are provided, these are estimates based on the information supplied by the participant.

Individual energy and nutrient needs vary depending on factors including metabolism, medical history, medication use, hormonal status and lifestyle.

Participants are responsible for monitoring their own wellbeing during the programme and should adjust food intake where necessary in consultation with the coaching team or an appropriate healthcare professional.

No specific outcomes such as weight loss, body composition change or health improvements can be guaranteed.

Eating behaviour and wellbeing

The programme is designed to support balanced and sustainable nutrition and exercise habits.

However, the programme may not be suitable for individuals currently receiving treatment for an eating disorder or experiencing significant difficulties with eating behaviour. Individuals in this situation should seek advice from a qualified healthcare professional before enrolling.

Privacy and confidentiality

All personal and health information shared by participants will be treated confidentially and processed in accordance with the UK General Data Protection Regulation.

Participant information will only be used for the purpose of delivering the programme unless participants have separately subscribed to other communications.

Intellectual property

All programme materials including workout plans, meal plans, recipes, guides, videos, audio recordings and written content remain the intellectual property of Holly Davison of East Fit PT and Josie Jones of The Mindful Cook.

Programme materials are provided for personal use only.

Participants may not copy, reproduce, distribute, share, publish or use programme materials for commercial purposes, including use within their own business or with their own clients, without prior written permission.

Unauthorised sharing of programme materials may result in removal from the programme without refund and may lead to legal action where appropriate.

Community conduct and content sharing

The Strong and Nourished community space is intended to provide a supportive and respectful environment for all participants.

Participants agree to behave respectfully within the online community and not to post content that is abusive, discriminatory, defamatory or otherwise inappropriate.

Participants must not copy, screenshot, record or share discussions, posts, comments or personal information shared by other members within the community without their explicit permission.

The providers reserve the right to remove participants from the community or programme without refund if behaviour is deemed inappropriate or harmful to other members.

Limitation of liability

The Strong and Nourished Programme provides coaching, education and guidance related to nutrition and exercise. It is not intended to replace professional medical advice, diagnosis or treatment.

Participants acknowledge that physical activity and dietary changes carry inherent risks. By participating in the programme they voluntarily accept these risks.

The providers will not be liable for any injury, illness, loss or damage resulting from participation in the programme except where liability cannot legally be excluded.

Nothing in these terms excludes or limits liability for death or personal injury caused by negligence.

Payment processing

Payments are processed through Kajabi using secure third party payment processors including Stripe and PayPal. Payment details are handled securely in accordance with applicable financial regulations.

Amendments

These terms may be updated where necessary. Updated terms will apply to future programme enrolments unless changes are required by law.

Governing law

These terms are governed by the laws of England and Wales. Any disputes arising from these terms will be subject to the jurisdiction of the courts of England and Wales.
